Maybe This All Ain’t So Bad After All…………

By now everyone knows that Judge Strickland indeed recused himself. I know we are all very sad about that as we all believed he was a very fair Judge, but maybe this ain’t so bad after all. Let’s start with his rebuttal, or better put, his response, granting the motion:

Order On Defendant’s Motion

While that was a sad read, I think that Judge Strickland had his say about the hypocrisy of it all and Kudos to him as he’s exactly right.

Order Of Recusal/Reassignment

Judge Belvin Perry will be the new Judge. From what I’ve been reading he’s a fair Judge, but he will move things along at a steady pace, and he’s rather no nonsense. That could be a very good thing in this case. Maybe the defense will pick their butts up off of the ground and get moving now, stop the foolish motions and stick to the things and motions they should be sticking too. Although, I’m not sure if they really need to file any more motions, but they do need to do the depositions and prepare the case, that which they have not really been doing, because a certain attorney might have to stay off Geraldo and other shows and actually work.

I do agree with everything that Judge Strickland said and especially that basically this opens the door that every time a motion is denied the defense can accuse the Judge of bias. That’s true. HELLO! WHERE IS THE FLORIDA BAR??? I think it’s way past time for a lawyer or 2 to be put in their place. I also think that the day is coming when reality will set in.

We no longer need to give this any thought. It is what it is and now we must get back on track. It’s no longer news worthy about the blogger or any of it. It’s over, done, let’s let it go and move on. It’s time. Unless there are any more developments this post is the last of my attention to this matter. I really believe Justice will come for Caylee and the defense shows us with every silly motion they file, just how desperate they really are. They obviously do not have a case, because if they did, they wouldn’t waste their time with these motions that are so silly. This is really what they are saying loud and clear………WE HAVE NO CASE, SO WE WILL TRY ANYTHING, WE ARE DESPERATE.

    Hi Niecey, always so good to read your ever so sensible blogs. I say the defense team are gonna wish they had Honorable Stan Strickland back as he was a good man and couldn’t have bent over backwords in fairness anymore than he did for this defense team of SHAME. I say KARMA defense team Karma~~ Your so right, they have no defense for their snothead client so all they do is try to find things to stall the case and hunt up good innocent people’s lives to trash. This case for them is like a band-aid and they might as well squint their eyes and bite their lips and just rip it off already as it is coming off one way or the other and not in their client’s favor.

    I read Judges order, and it made me smile… Then I read it again, and hit the print icon.. May his wisdom never be forgotten.
    I then went to MSWord and typed a letter to him thanking him for all he has done in the qwest for justice for Caylee, and told him he remains admired and respected. I hope others will write and express their admiration for him also.

    Thank you. I appreciate that. You are so right, the defense will regret this one. I do believe that. I love the way you used the band-aid. I totally agree with that! They are stalling and wrecking lives, but that will soon change I’ve a feeling. It’s all coming back around to them.

    Hey Scott! Woo! Please don’t use that word. I don’t want to call the Judge those kinds of names. Judge Perry is supposed to be more strict, but Judge Strickland was a very good Judge on this case, because it was so “high profile” he had to be very careful not to come across as bias, and look it happened anyway. I don’t think this Judge is going to put up with the foolishness.

    It is very sad that JS has left, I wanted to see him win his last case and look at retirement!
    I am impressed with what I have read about the Judge, he is no nonsense, and hard core!

    Hi Niecey and all. What could possibly be next in this case? I don’t even want to venture that. Every day is a new swirl of the bowl. I just hope that we all don’t have Alzheimer’s by the time this case actually comes to trial. We’ll need hand books and score cards to remember all the names and what side they are on.

    I think, if anything, the new judge would push things forward a lot more quickly, it won’t set the case back years.

    In any situation, the issues in these motions need to be dealt with before the trial in order to lessen the appeal possibilities.

    If this wasn’t a death penalty case, it’d be moving along a lot more swiftly, I’m sure.

    Niecey and friends…Initially I teared up when hearing of Judge Stricklands recusal :cry:
    I cheered up after reading his order :mrgreen:
    Judge Strickland has more integrity in his little finger than the entire defense team…he will be sadly missed.

    I would dearly love to vent my feelings about the blogger whose scathing vitriol has been delivered on many here…especially Niecey and Bees but it would be disrespectful to this site. Suffice to say it pleases me greatly to know that said blogger is spending a huge amount of time deleting his rude and vicious comments [bet he wishes he could take back his giggling remark about Judge Strickland being married.]

    I must agree that Silver’s comment brought us all back to the reality of why we are here seeking justice for Caylee.

    I wonder if Judge Perry will demand that KC attend all hearings?
    I also wonder if he will allow the hearings to be broadcast live?

    Sadly my sneakers will have to remain locked away for quite some time… as I expect Baez/Lyon & Mason will be seen “crowing” about how they “won” in the near future…grrrrrrrrr!

    We can expect that defense attorney Jose Baez and his team will try to discredit the letters and jailhouse talk as not reliable information (i.e. obtained from snitches who simply wanted a better deal in their own cases). But how many bullets can Baez dodge? How many coinky-dinks can he possibly claim? How many other people can he point fingers at? Ladies and Gentleman, I believe the People rest and can prove their case beyond a reasonable doubt. Mark my words!

    Hey Humble! True, but that to will work out. I don’t think that will turn out to have been such a wise move for said person. JS had just moved to civil court right after he got this case, so he’s still on the bench, just in civil court. The Chief Judge had asked him to keep this case when he went to civil. I don’t think he’s retiring just yet. Hopefully this case will be tried before he does. I think it’s sad this happened too, but this will come back to bite a few.

    Great article Niecey, I am sick to death of the DUH FENSE whining about CMA getting the DEATH Penalty. WHY is KC’s life WORTH more than that of an innocent child?

    C Mason will probably “have his heels COOLED too, something Judge S.. chose NOT to do, I hope thats over!” I hope this Judge puts the Defense in its place with their first MOTION so they understand that this is NOT their playground. Can’t wait.

    Hey Jill! I felt the same way. I was sad and angry at first, but after reading what he wrote I was cheering him on. As far as that said blogger, the attacking days will not go without notice anymore, so if and when he does that it will be much more of an issue, but I just consider the source. When people behave that way, it always comes back around to them. Silver’s comment was very touching. It was hard to read, yet it was so true. I think we needed that reality check. From what I’m reading Belvin Perry is Chief Judge Belvin Perry. It was the Chief Judge that asked Judge Strickland to remain on the Anthony case, so if he’s one and the same, me thinks there will be NO NONSENSE. :mrgreen:

    Wow, I had an extra day off this weekend and look at all that happened!

    I think you had two oppossing forces working for a common goal on this one. I believe Judge Stan was over it… tired of the grandstanding clownish behaviour of a pompous fool who found a way to stay in front of the TV cameras for longer than his allotted 15 minutes. I am not saying he purposely did anything get this motion filed, he just wasn’t as careful as I am sure his inner judge warned him to be with KC un-supporters. He is not a dumb man and he has been a judge for many years. The multitude of media attorneys chastising him underestimate his ability to forsee consequences – the very skill that makes him a successful judge.

    On the other side, you have the pompous fool whose success with the media to date has nothing to do with any skill on his part, but basically blind luck in being involved in a story which the media is salivating to get to any new bits of info. He apparently has failed to realize that his greatest media opportunities are actually within the court itself because he cannot be edited and may say anything for national broadcast – including suggestions of client innocence and stranger danger. He is able to utilize this astounding media platform to its fullest because of the leniency of Judge Strickland.

    Yet, he decides to request the judge’s removal from the case… why? Obviously, as attested to by the out-of-date notary stamp, because of Mason.

    I believe Mason thinks being a good ol’ boy in the area, he will get a judge that likes him a bit more than Judge Stan… don’t know if that is how it worked out for him, but I think Mason had a problem with JS.

    My take on this move is that Jose is weak – extremely weak both legally and tactically. He is well out of his depth. He is panicked. A similar change in strategy has occured with each new attorney added to the ever-changing cast. But there is no coherence of thought, no overall battle plan, no sense of unity. Motions are filed shotgun style, some at cross-purposes. Every new attorney means a shift in focus. This is just the latest example.

    My prediction is that every denied motion that is still relevant (like the TES records) will be re-filed for a new decision by the new judge. Then there will be a motion declaring the procedure for filing motions is unconstitutional and the court must order that all motions the defense may wish to file, either now or in the future or past, be considered passed. Then one stating that finding people guilty of crimes is both unconstitutional and a cruel and unusual punishment, so the client must be set free.

    Yes, it’s been a busy start to the week. I do understand what you are saying and this may be a small battle win for Baez, but the war is lost and that is why he and Mason are fighting this way. I do agree with the changes each new member brings, but the war is lost for the defense and I still believe they will fight on this level, until it really begins to cost, and then they will want to deal. I don’t think Casey will walk. In fact I don’t think she will get less than 30 years. She may yet get life, but in the end, she will not walk free in her young life. She will pay for what she has done. The defense is showing their desperation and while Baez may fade in and out, his incompetence has forever marked her chances, coupled of course with her unwillingness to tell the truth, her stupidity in leaving the evidence she did, and her overall disposition, The wheels of justice will turn, and I believe at a bit faster pace now.

    It makes me sick that an otherwise honorable man has to step aside on the slightest hint at bias while the entire “clown team” has been parading around with no case and “bullying” their way to drag out the inevitable end.

    This is a basic flaw in the judicial system in an attempt to be fair to all. Some people will always take advantage of such “loop holes”.

    i once did some freelance investigation for a young woman who was facing retrial for a mruder i know she didnt commit (the prosecution has never even proved she knew the guy). and i found it very frustrating because all the work i did in forensics and finding witnesses or asking the lawyers to find something/someone fell on deaf ears. our motions were always thrown out and if we ever asked the judge to remover herself for bias we’d have been laughed out of the court (ironically, she WAS Bias).

    so im very frustrated and angry when lawyers will go to the max for a POS Sociopath baby killer like casey.

    Perry was described as a no-nonsense judge, who is tough on the law and is expected to be tough on the budget that Casey Anthony’s defense will be able to spend.

    “He’s not going to accept any nonsense,” Orlando defense attorney Mark NeJame said.

    NeJame has practiced law in front of Perry for years.

    “(He’s) smart, doesn’t suffer fools lightly and will not put up with any antics,” NeJame said.

    Attorney Richard Hornsby said the appointment of Perry could have a dramatic effect on how much money Anthony can hope to get from taxpayers to help funder her defense. The matter has yet to be settled.

    “To suddenly have the judge who sets the budget for the entire Ninth Judicial Circuit on your case, he’s going to be less likely to authorize fees unless he absolutely thinks they’re necessary to defend Casey Anthony,” Hornsby said.

    NeJame and Hornsby are among six attorneys who spoke to WESH 2 News about the effect of the removal of Strickland will have on the Anthony case. All of them said the appointment of Perry will not help Anthony’s defense in their quest to have the death penalty taken off the table.

    “I don’t think he’ll have a problem imposing the death penalty. For him, I don’t think it’s a moral question. It’s just a legal question about whether or not it’s appropriate,” Hornsby said.

    Anthony’s defense attorney, Jose Baez, wouldn’t comment on the appointment of Perry to preside over the case.

    On p7 they state “The rules do not require Miss Anthony to disclose mitigation witnessess prior to trial.” {Does this refer to the penalty phase only?}

    Does anyone else think that there is another “player” that Baez doesn’t want investigated? If so then I sure hope this is “above board.”
    I know I sound sceptical but I just don’t trust this unethical defense team.

    I suspect that either
    1) They were expecting Judge Stan to deny the motion.
    or
    2) They knew that Judge Perry would be replacing him.

    This may be a ploy to discredit Detetective Melich due to his blogging [he called himself Dick Tracy.]

    Sumptin fishy goin on…I don’t know what it is yet but I feel it in my “sneakers.” :mrgreen:

    Yes indeed. The inept, inexperienced attorney with a big mouth has really bitten off more than he can chew this time it appears.

    The remarks by NeJames, Hornsby, & B Sheaffer, all say that this is a NO NONSENSE Judge. Think about it! You would think that the Defense would be embarrassed by these statements among others, but sadly, it probably went right over their heads. I hope C Mason was embarassed by Judge S’s remarks, but even if that went over his head, he UNDERSTANDS what this Judge is going to mean to the defense, NO DELAYS, the Judge is running the Court Room, the Trial is about evidence, not showmanship.

    It is awesome that Perry presided over the Grand Jury that indicted KC.

    Remember when C Mason threatened that the defense would APPEAL any cost denied by Judge S? Bet he has wiped that stupid smile off his face with his “unfortunate yellow teeth” & will reconsider the threat.

They are basically breaking the rules, big time! They should have been forthcoming all along, and they have not. I hope Judge Perry gives them a serious scolding on this issue. Judge Strickland tried to force them to do it, but somehow they seem to think they don’t have to play by the rules. In other words they are not playing fair and they could be getting themselves in real trouble. One can only hope!

    The courts, the prosecution and the defense by now must realize that prominent cases will be discussed on blogs by more and more people.

    I doubt that future defense teams will be able to use the Baez excuse that his client can’t get a fair trial because of what is said on blogs.

    It doesn’t matter where the trial is moved to…the blogs will follow…probably gaining membership from the new location.

    If a COV is granted by Judge Perry I suspect that ONLY the jurors will be brought in from another County [and sequestered.]

    If in the unlikely event the trial itself is actually moved I suspect there will be a sizable amount of protesters outside the courtroom…just the same as there will be in Orlando.

You see there was a high profile murder case in my part of Florida a while back and the info was made available to the public, only if they were willing to go sign in at the court house to view it. Security and Background checks and the like. Some of it was sealed and the public could not view it. The Judge made it that way due to the sensitivity of it. The lawyers could have requested such, but chose not to.

    April 30th should bring semblance of order in the court room! Regardless of JS recusal, the case should make the 2011 date.
    While you have the naysayers, JP will facilitate/expedite the proceeding’s. Let me interject, it usually is contingent on whom you ask and on what day. Be that as it may, I’m of the mindset to consider the catalyst- impropriety so noted. My one question, what took the Defense so long?

    I’m not sure if the defense really thought that through. I think they were lashing out, and thought they’d take a chance. I think they will cry foul at any time they think they can show some justification for it. They seem to be living in the moment, not planning ahead. I guess it’s possible they thought that far ahead, but I think if they really did, they would have done more to prepare a case by now. What I like about what I’m seeing about Judge Perry is that he’s fair, but he doesn’t play foolish games and it’s high time the defense was brought back into line on that note.
    I think we will be seeing them do a lot more of what they should have already done now that Judge Perry is on the case. I’m not faulting JS by any means. I just think he jumped through hoops trying to be fair and come across as such. I think he gave them more patience than they should of had. I do think he’s an awesome Judge. I think Judge Perry is a great Judge too.

    Update for Monday, April 26:

    As of today, no new motions filed with the Orange County Clerk of Courts. Which again begs the question, why were there media reports motions were filed by defense last Monday? Where did that information come from? Was the recusal being granted a shock to the defense?

    There has been an Unavailibilty Notice added as of last Friday, April 23. My guess is this means Jose does not want to attend court with the new judge this Friday. Seems like a hard sell to me, as Jose’s excuse for not being ready with stuff has always been that this single case takes up all of his time… so what would he be doing that is more important that this case? If whatever he is doing is for this case, what is it that cannot be scheduled around court? In any case, seems like a great way to start off a relationship with a new judge.

    I was also noticing on the clerk site that below the actual motions, orders, etc, there is a receipt log showing copies of some of this stuff being made and paid for by various individuals including Belich, Lyon, Bristow, a ton for KC – which I interpret to be her counsel, and assorted others. The interesting thing is that you apparently are not required to give your name as many say Media, Customer, or Copy. But far more interesting are the ones that say Sealed or Expunged… why would the name of someone that bought a copy of some record connected to this case need to be either Sealed or Expunged? Why would they not have remained anynomous to begin with?

    For the many researchers out there – there are a ton of names on that list that have never appeared in any KC article – probably would be great fun to learn who each is and why they felt the need to buy a copy of any of the records of this case…

    It now appears that Baez will be unavailable for 11 days during the month of June and WILL be attending Friday’s hearing {not sure which icon to insert here…you make the choice} :mrgreen: :evil:

    Interesting to note that June 7th is scheduled for the Civil Trial. I don’t think Baez is involved with this but with all the changes who knows?

    Although we haven’t seen a motion it is reported that Mark NeJame will be asking Judge Perry to make a final ruling about the Equusearch records. It seems that Baez & Mason turned up at his office last Friday but left when the media arrived :roll:

    The Caylee Daily tells us that KC is receiving very few short visits from her attorneys. They also state that G & C continue to put money in her commish a/c. I firmly believe that the ABC payment of $200,000 was shared by both Baez & the Anthony’s…possibly with the stipulation that G & C’s share be used SOLELY for KC’s jail expenses etc. [I wonder if we will ever find out if my assumption is true?]

    As far as Jose, well, he’ll be there, from what I understand, but I’m not sure why he did the unavailability notice, but I’m guessing he was going to try and weasel out of it, and by the time I read, he had changed his mind. I don’t think this case really is a priority for him, but more the attention from it.
    Me thinks Baez likes the media better than the court. Maybe he missed his calling? :lol:

    Thanks for the links on Haleigh’s case! I’m thinking this is a lesson for all of them to learn. The court is not playing with that bunch. She only had one count, if memory serves me correctly, so the rest should get some hard time. That’s a good thing.
