Tammi Smith, the woman whose trial we recently followed has been sentenced today for the charges against her that are related to the disappearance of Gabriel Johnson. She was found guilty of forgery and conspiracy to commit custodial interference in May. She was facing anywhere from 1 to 7 1/2 years. She was sentenced today to 30 days in jail and 3 years of supervised probation for the custodial interference, 30 days deferred jail time (which she can avoid with good behavior) and 3 years of supervised probation for the forgery charge, she was also told she was eligible for work release. She will not go to prison. The judge’s reasoning was that she had no prior criminal history.
You may remember that Tammi was the woman who wanted to adopt Baby Gabriel and tried her best to force Logan McQueary (Gabriel’s father) to sign his parental rights. Elizabeth Johnson (Gabriel’s mother) wanted Tammi to adopt him. Tammi forged documents and interfered to the umpteenth degree and well, it was due to her interference that Elizabeth took Gabriel to San Antonio Texas in the first place. Tammi had recommended that she take the baby and run with him, in another attempt to force Logan’s hand. The rest is history. Either Elizabeth killed Baby Gabriel, as she first told Logan, or they devised a way to sell him into an illegal adoption. Elizabeth has only admitted to killing him, but then she retracts that and there have been some indications that she may have passed him off. She goes to trial in September.

Was this Justice. NO, Not in my opinion.
This woman should have done some prison time at the very least
half of the time she could have been sentenced to.
Her involvement no doubt had much to do with the line of thinking
the baby’s mother had.

I agree with you that she was an accomplice. The whole thing went down because she had a plan.
It really doesn’t matter if she had no idea of the final outcome, because she orchestrated what led to it. JMHO.
Now Elizabeth does have a record. I wonder if they will go light on her? Oh, that’s right they call her mentally unstable, as her trial was delayed more than once because she was not competant to stand trial. She has been determined competant now.

The sentence was far too lenient – I hate slap on the wrist type justice which doesn’t act as a deterrent – it actually sends a message to offenders that we don’t care…grrr!!!

No, this was not complete justice, although it was close and generous of the judge. I do not think she should have gone to prison. I think she should have gone to jail fr at least 30 days and not get work release during that time. Then she should have gotten work release and the 3 years of probation was excellent.
She should also have had to do community service and I did not hear if the judge ordered that or not. He did say that he wanted to check on her himself, which is good as he obviously sees that she was only interested in giving a speech on the tenents of christianity and not a true apology and confession to the court, his honor, the affected people, and the Lord, asking for forgiveness for taking a baby away from his father

I respect your opinion, though I think it should have been a bit harsher, I would have been much happier with the sentence it if had been as you propose.
